Saving Private Heary

The recent brouhaha that has created an imbroglio between Mr. Richard Kaul (aka Dr.) and Dr. Robert Heary (Neurosurgeon) has been high drama at its best.  For those of you that haven't been following this saga, Mr. Kaul has been fighting the forces of evil, involving a total conspiracy between the State of NJ Medical Licensing Board, the orthopedic and neurosurgical community, the press, his former patients, and "Fat Boy Slim, aka Chris Christie.  (Let's kick some more dirt on the round mound of rebound.) The irony of it all is that Poor Richard sees himself as a pioneer, a visionary, as being misunderstood. Who knows, maybe a descendant or protege of Michael DeBakey? In November of 2013, Mr. Kaul blogged on his own blogsite, while sitting in the lotus position, asking the question, "Who is the Spine Blogger?" One must admit, even TSB doesn't have the panache that Mr. Kaul exhibits when blogging.  Richard, you don't mind if I call you Richard?  Delusion? Deceit? I must suspect that you never heard the express that "people with a glass jaw shouldn't start a fight."

As for Private Heary?  I do declare, even TSB must come to his defense.  I feel like Captain John Miller in his quest to bring Private James Ryan home back to comfort and loving arms of his mother.  TSB normally wouldn't give Mr. Kaul the time of day, let alone some publicity on the blog, but when someone accuses The Spine Blogger of highly inflammatory comments, let alone, making or allowing racially disparaging remarks about Indian physicians, that's where TSB draws the line. Richard just for your information, I love Indian Food and hang out with Indians, not the type that run around with bow and arrows. Professional toxicity, c'est moi.  Rather than get into a pissing match with someone insignificant I would rather let Richard's track record speak for itself.  I watched your "self-serving" YouTube Videos, intellectual discourse at its best coming from someone who is a self-proclaimed spine surgeon.  So in a gesture to ensure you that the symbolic head has not been cut off…………..drumroll please………..Robert Heary is not the Spine Blogger. So in closing

Sounds to me like Dr. Kaul struck a nerve to get this attention that no one cares to read. I got sort of excited that we finally had a post, but this is crap blogging. This is like watching Jerry Springer.

  12. Precision Spine is not new, its Spinal USA. Whats new is Zavation, which has been started in Pearl MS by the same guy who started Spinal USA. Products are eerily similar and the patents assigned to them are the same patent holders that have assigned IP to Spinal USA. You should check out their website and their "Community" page. Such Altruism! I called the local Salvation Army in Pearl and the corporate sponsorship director had never heard of Jeffrey Johnson, Zavation or Spinal USA, but Zavations website has the Salvation Army logo plastered all over it as if they were a big sponsor.

Obviously, if you have a bunch of products that are vastly the same, then the only way a company can get someone to buy theirs is to have a good salesman. discounting the relatively few bad apples who get all the press, most reps don't have consultants and don't bribe docs, we barely even buy them lunch anymore. The ones who can't sell and get desperate and the ones who do all this shit you love to talk about. They are losers but there is obviously a market for bribery among the pillars of our our society, the medical doctors. Walk in the lounge and see which ones are reading the Wall Street Journal and which ones are reading Spine Journal and you will know which ones to trust.

    5. Maybe the guy at salvation army needs to get out more. The Precision Spine facilities are about 2 miles from The Salvation Army. Just because the guy in Pearl hasn't heard of Jeffrey Johnson doesn't mean anything. The way Jeffrey treats his employees, I would believe that he would be donating to The Salvation Army. By the way, is it just a link, or does the Zavation site actually say we donate to The Salvation Army, I don't remember. Some people love to throw mud, and not really know what is going on.

    1. His partner Uppal was my surgeon. I was just informed of the fake spinal hardware he put in me at the age of 28. By the age of 32 I underwent hardware removal due to the pain. I was just in UPPALS office last Tues and do you think any of this was mentioned? Not a word he had been my trusted dr. The last almost 10 years...

  26. California Hospital CEO and State Senator Indicted
    The FBI announced today that Michael D. Drobot, former owner of Pacific Hospital in Long Beach, has been charged in a health care fraud scheme that involved tens of millions of dollars in illegal kickbacks in exchange for referrals of thousands of patients who received spinal surgeries. The referrals to the hospital led to more than $500 million in bills being fraudulently submitted during last five years of the scheme, much of which was paid by the California worker's compensation system. In April 2013 the Wall Street Journal reported on the investigation by the U.S. attorney for the Central District of California into allegations that Drobot paid kickbacks to physicians so they would refer their patients for spine surgery at his facility. Drobot owned a spine distributorship and would inflate the price of the implants used at his hospital. This price inflation allowed him to pay a kickback of $15,000 per lumbar fusion surgery and $10,000 per cervical fusion surgery and recover this payment by passing it on to the insurer. The California Workers Comp system permitted hospitals to pass on to workers' comp insurers the full cost of medical devices implanted in spinal surgery patients. Drobot also admitted in his plea agreement that he paid bribes to Democratic California State Senator Ronald Calderon in exchange for Calderon performing official acts to keep the spinal pass-through law on the books. Calderon was indicted on federal charges yesterday for allegedly accepting bribes from Drobot, as well as undercover FBI agents seeking official acts in relation to other matters

  29. I know this is not the subject of this strand of comments. I HOPE someone can help me. How can you find out if the hardware implanted in your spine is counterfeit? I had spinal fusion lumbar 2011 at Pacific Hospital Long Beach. I have my records and they state this. International Implants Registered manufacturer. It states vendor product ID, description and internal product ID. If I list these numbers can someone tell me who the manufacturer is?

    1. I am sure your implant is legit. There are hundreds of FDA approved pedicle screws on the market. You may want to try the FDA website under the medical devices tab and see what you may find.

    2. Spine ID question : Eventually (most) patents want the hardware removed later on down the line, normal procedure for (most) patients. Some patients complain of feeling it, creaking feeling within the spine etc... Of course this is all done once the spine hardware and bone have both done their job, fused the areas that were meant to be fused, a simple xray can detect that. Go see your Dr and ask them about getting the hardware removed and DEMAND that you get to keep it.........I have been involved in countless hardware removals and even the Dr doing the removal instructs the O.R. staff to make sure the patient gets the hardware. DEMAND that you get it back.

    3. Spinal Solutions were using counterfeit hardware made at a local machine shop. The feds actually had the manufacture engineers examine the so called counterfeit hardware thoroughly and they were deemed as counterfeit. The story is all over the internet.
      I always wondered how come S.S. CEO / owner was able to afford all of the fancy cars / trucks / airplanes etc.........it cost him pennies to make the harware but would inflate the prices astronomically !

  30. I am the patient from above. I read Spinal Solutions distributor was owned by Drobot the former owner of Pacific Hospital Long Beach. So this hospital owner where I had my spinal fusion also supplied my doctor with my hardware. From what I read International Implants was supplying counterfeit hardware.

    If I list the vendor number or product ID can anyone on this site determine where it came from. My new doctor cannot. He said my records do not look like correct surgery records. Was Spinal Solutions ONLY using counterfeit hardware, OR only part of the time is my question? I have had a lot of complications after this surgery. I have a cage/lumbar. My former doctor implanted through my stomach and back. I asked if it could only be done going in through the back, and he said no. Worst experience of my life at that hospital, and the pain after. I wish my doctor would have taken my life instead of doing this to me.

  31. I did go to the FDA web site (thank you for your advice), and imputed the codes from my hospital records and nothing comes up. That site is very confusing. My records do not say the brand of my hardware just lists vendor product ID, description, and internal product ID. Thank you for your comments.

    1. Mr. Patient, International Implants WERE NOT using the counterfeit hardware, Spinal Solutions was the company using them. If you dont mind could you provide the Dr's initials who performed the surgery ? (INITIALS ONLY PLEASE ) It sounds like you had what is normally called a "front & back" OR anterior / posterior lumbar fusion (A/P).
      By the way, Spinal Solutions distributorship was not owned by M. Drobot ; Pacific Hospital used International Implants exclusively. I believe the manufacturer was Alphatec for the "hardware" used in both the front and back.

  32. Yes, you are correct with the surgery (A/P surgery). My surgery records contain International Implant information. I thought is was the same company as Spinal Solutions. They were both listed in the complaint. So if my implants came from International Implants, and I had this surgery at Pacific Hospital Long Beach, then what you are writing I do NOT have to worry that my implants are counterfeit?       In my opinion I do believe your implants are the real deal, NOT counterfeit.

    2. International Implants are not legitimate. That is owned by Drobot and listed in the state complaint as distributor for counterfeit implants. Alphatec appears to be involved some way. They are not being transparent with patients who ask about their implants and if they are from Alphatec. Why?

The two men that had the courage to say something and put themselves in harms way to save literally thousands of patients? I don't know these two men. But what I have been reading they are heroes. The world needs men that are willing to put themselves on the line to assist others that are unable or unaware that they are victims of greed. I support men like these men.

    1. They do not. The hospital is responsible for tracking implants back to a patient. Many companies wont allow patient names to be on the orders due to HIPPA. As a distributor, I keep that info for the purposes of reconciling POs to the proper case and for revision purposes in years to follow so we can know what is implanted if we have to take it out, but I am not required to do that.

  52. Stryker strikes again only it's worse this time! Their latest batch of victims, the Cervicore, victims were injured even more grievously than the hip implant victims and there was even more criminality involved. CerviCore is an artificial disk implant meant for implantation into the cervical spine. Not only is it a metal shedding Frankenstein design like the Stryker hip implants, the Cervicore disk never received FDA approval for use in patients. It gets worse, the Cervicore disk never even received FDA approval to be used in clinical trials or IDE (Investigational Device Exemption). The Cervicore disk is such a piece of shit that it could not even get and IDE from the FDA but that didn't stop Stryker's doctors from implanting them in the spine of patients.

    Currently the is a class action lawsuit being filed against Stryker Medical.

    What is Stryker Cervicore Device?

    According to the experimental study documents, about 400 patients may have been part of the study, with around 200 of them receiving the CerviCore device.

    All nine plaintiffs in this suit say the CerviCore device has caused them serious harm. Most are suffering metallosis symptoms and they allege Stryker either will not perform metal exposure testing or performed the testing and will not release the results. The symptoms are very similar to the metallosis alleged to be caused by Stryker Rejuvenate and ABG II metal replacement hips.

    Thomas Errico, MD designed the articulating saddle shaped device with the aim of preserving motion after implanting it into the intervertebral space between two vertebrae of the cervical spine.

    The inherently unstable saddle shape design of the CerviCore device in combination with the use of a heat treatment was allegedly known by Stryker to escalate the deterioration and wear properties of cobalt chromium (nickel and molybdenum with titanium plasma spray) in metal on metal articulating devices.

    This effect was a well known red flag for causing catastrophic outcomes in the device industry.

    Allegedly Stryker Howmedica's own research team of engineers, Wang, Wang & Gustavson have demonstrated that the heat treatment caused rapid deterioration of articulating wear properties in their published research titled: Metal on Metal Wear Testing of Co-Cr Alloys,

    Metallosis is a medical condition that is caused by the absorption of metal debris ions, particularly Cobalt and Chromium, which are the component elements of the device.

    The metal debris occurs because of the grinding action between the metallic component parts that rub together, lead to the wearing down and degradation of the discs.

    Test Subjects Claim that Stryker Abandoned Them

    All nine plaintiffs say Stryker / Howmedica abandoned them. In most cases, the company sent a representative saying Stryker wanted to continue the CerviCore study, then, shortly after they signed new waivers, it abruptly ended the entire study and stopped monitoring their conditions.

    The suit seeks damages for all the medical expenses, the lost work time, and the pain and suffering each person has endured. It also asks the court to punish Stryker / Howmedica and send a message that the way it treated these people is unacceptable.

    Cervicore was not Approved by FDA

    The FDA did not approve the application for the legally required investigational device exemption (IDE) that had been submitted by Stryker Howmedica Osteonics in 2004.

    Without an order from the FDA granting a valid IDE to the sponsor, Howmedica Osteonics, dba Stryker Spine, the CerviCore device was absolutely prohibited for use on human subjects in clinical trials.

    Stryker's Alleged Bad Acts

    Instead of complying with the FDA decision for further testing of the CerviCore disc, Stryker switched the CerviCore Disc that was used in the application for an IDE that was denied with and replaced it with a second CerviCore disc

    1. Do you feel it was really the Dr's at fault? More likely it was the reps and or companies they represent. I know the approval process is usually between us, our product providers, and purchasing. The Dr. is expecting us to monitor the legal E's to do our job. I've yet to have a surgeon ask to see the FDA papers. It's assumed that what's being shown is legit, tested, approved etc..I fear lack of ethics as well as accountability, follow up, service, and trust is quite common in the sales/provider side.

    Example of an epic management failure in spine:

    1997 - Sulzer Medica aquires SpineTech for 597 Mio USD
    2002 - Before problems with a defect implant coating in the US, Sulzer was on it's way to buy Zimmer. However, after that scandal caused by an US subsidiary and a terrible rebranding to Centerpulse, they became a takeover target themselves.
    2003 -Zimmer acquires the old SpineTech business (MN) through the Centerpulse acqusition.
    2008 – Zimmer acquires the Spinal Concepts business from Abbott Spine.
    2014 – Zimmer acquires Lanx as part of the Biomet merger
    2016 – Zimmer acquires LDR Spine
    2022- Zimmer spins out Spine business and Dental business as new public company – ZimVie. Never profitable. Stock tanks.
    2023 ZimVie sells spine and exits the spine sector.

    What about the money?
    Spinetech : $597 million
    Spinal Concepts: $360 million
    Lanx: $147 million
    LDR: $1.0 billion
    A&E Medical Corporation: $250 million
    Total Acquisition Costs: $2,354 million

    So after investing over 2354 million USD into spine, the spine business is sold for 375 million USD by the end of 2023.

    If these epic losers had invested in the Swiss Spine Team at Centerpulse back in 2003 -2007, things would have taken a much more successful path. Even better would have been if Sulzer never aquired Spinetech and managed their entry into the US market with a legal structure that doesn't destroy the whole company, if a US subsidiary fucks up epically.

    Now this story comes to and end Zimmer management deserves. Other Swiss companies should learn from this example. Never give control to people who vote a guy like Trump into the highest position of their republic.
